Dear Mr. Levin,

The Digital Media Association (DIMA) represents the world’s leading music streaming services in the world: Amazon, Apple Music, Feed.fm, Pandora, Spotify and YouTube. We are writing to express our position regarding one aspect of the Performers’ and Broadcasters’ Right Bill (Amendment No, 5786-2026), currently under consideration before the Knesset – namely, the proposed performers’ making available right in sound recordings.

We commend the outcome of the Economic Committee’s two years of work on this right, which is fundamental to music performers’ ability to negotiate payment for their recorded performances in ways aligned with the international standards of copyright protection reflected in the WIPO Internet Treaties.

In its Articles 2(2)(d), 12(a) and 12(b), and 19, the Committee establishes the new right as an exclusive and fully transferable right, applying to performances recorded after the commencement date and not subject to mandatory collective management. This framework reflects global best
practices and aligns with Article 10 of the WIPO Performances and Phonograms Treaty.

Mindful of the pressures on the Knesset’s and government’s work at the current time, DIMA respectfully submits that if the Performers’ and Broadcasters’ Right Bill (Amendment No, 5686-2026) is not adopted during the current parliamentary session, the above-referenced provisions
regarding performers’ making available right in sound recordings should be retained and incorporated into any future proposal by the Ministry of Justice. Doing so would preserve the agreement reached by all stakeholders in the music sector following negotiations led by Chairman Bitan. It will align Israeli performers’ law with the international copyright treaty and music business norms.
