House Proposal to Force Standard Technical Measures Would Undermine Successful Copyright Protection Efforts

Association for Leading Streaming Services Continues to Support a Flexible and Market-Driven Approach for Preventing Infringement

Washington, D.C. (December 15, 2022) – The Digital Media Association released the following statement from President and CEO Garrett Levin today regarding H.R. 9541, the SMART Copyright Act of 2022, which seeks to impose new requirements for the use of technical measures to identify and protect copyrighted works online:

“The requirements in this bill would disrupt the existing, successful cooperation between streaming services and the music industry to promote the legal consumption of music.  Such disruption won’t stop piracy – but it could damage flexible, nimble, voluntary, and market-driven solutions that are working. Last year, with revenues from streaming leading the way, recorded music reported 23% growth and achieved record setting revenues. This represents a sea change from days when piracy nearly wrecked the music industry.

“DiMA’s member companies provide the best and most innovative remedies to piracy – legal access to music, available anytime, anywhere – which they’re able to do under existing law. Government-issued technology mandates, on the other hand, get stale quickly and are rarely successful. DiMA believes industry-driven approaches are the best way to prevent piracy and offer a superior approach to inflexible legislative mandates.”
