Bill 24: Submission of the Digital Media Association to the Committee on Citizen Relations

Dear Committee members,

We write in advance of the Committee’s clause-by-clause consideration of Bill 24, An Act to protect consumers against the misleading or fraudulent use of a person’s identity or image, to express concerns regarding potential unintended consequences, and to recommend the Committee address the issues described herewith.

The Digital Media Association (DIMA) is the trade association representing Canada’s leading music streaming services including Amazon, Apple Music, Spotify and YouTube. DIMA’s members make it possible for music fans to legally engage with music whenever and wherever they want and discover the music that they want to hear.

DIMA supports the intent of Bill 24, to protect artists and others against the use of a person’s likeness or voice without the person’s consent. Our members are committed to ensuring content on their services are properly licensed and free from deceptive content. DIMA members understand that AI technology, particularly generative AI, can raise questions around the integrity of an individual’s likeness and voice, something that resonates in the music industry. Our members have nothing to gain from deceptive music in their supply chain. Those who would falsely capitalize on the creative identity and expression of the artists that listeners love should be held accountable. We therefore believe there should be appropriate safeguards to protect an individual’s name, image, likeness and voice in this context.

However, it is vital that any new law sets clear, appropriate bounds for all parties involved, to support innovation, and adapt to future changes in technology while ensuring individuals can protect their personhood. We respectfully submit Bill 24 creates uncertainty and unintended consequences that undermine its laudable goals.
